FDA WARNING_LETTER - 1 stop supply corp. - June 13, 2024
The FDA issued a Warning Letter to Troy Duncan and Lilia Ahmed, operating 1stopvapor.com, for offering unapproved electronic nicotine delivery system (ENDS) and e-liquid products for sale in the U.S. The FDA's Center for Tobacco Products reviewed the website and determined that products like "Cereal Trip - Bad Drip Lab 60mL – 3mg," "Don’t Care Bear by Bad Drip Labs 60ml – 3mg," and "Funky Republic Ti7000 Smart Disposable - Blue Red Mint" are "new tobacco products" that lack required premarket authorization orders under Section 910(c)(1)(A)(i) of the FD&C Act.
These products are deemed adulterated under Section 902(6)(A) and misbranded under Section 903(a)(6) of the FD&C Act because they were not commercially marketed as of February 15, 2007, and lack FDA marketing authorization or exemption. The FDA also expressed concern that the "Bad Drip Labs" e-liquid products' packaging imitates prescription pill bottles, potentially appealing to youth and encouraging concealment.
The letter requires a written response within 15 working days detailing actions taken to address violations, including discontinuing sales and a plan for future compliance. Failure to comply may result in regulatory actions such as civil money penalties, seizure, and/or
