FDA WARNING_LETTER - 2000cigs.com
The FDA's Center for Tobacco Products reviewed the websites http://www.2000cigs.com and http://www.1001cigarettes.com, determining that cigarette products offered for sale to U.S. customers are adulterated. These products are considered tobacco products under section 201(rr) of the FD&C Act.
The violation stems from the sale and distribution of "modified risk tobacco products" without an FDA order, as required by section 911(a) of the FD&C Act. Specifically, the websites use descriptors like "Lights," "Super Light," "Ultra Lights," or similar terms (e.g., Benson & Hedges Smooth Lights Gold King Box, Marlboro Light/Gold Box, Parliament Light/Blue, American Legend White, Gauloises Blondes Ultra Light/Yellow). Such descriptors classify these products as modified risk tobacco products under section 911(b)(2)(A)(ii). Selling these without an FDA order under section 911(g) renders them adulterated per section 902(8) of the FD&C Act.
The FDA requires immediate correction of these violations and similar ones, ensuring all tobacco products and related advertising comply with the FD&C Act.
