FDA WARNING_LETTER - Bad Modder Fogger, LLC - September 03, 2019
The FDA Center for Tobacco Products issued a Warning Letter to Ronald Peeples, Jr. regarding e-liquid products sold on bmflabs.com. The FDA determined these e-liquids are tobacco products under the FD&C Act.
The primary violations are: 1. **Sales to Minors:** An FDA investigation revealed the sale of "Blnd’d Braz-Berry Grape Açai e-liquid" to a person younger than 18, violating 21 C.F.R. § 1140.14(b). This renders the product misbranded under section 903(a)(7)(B) of the FD&C Act. 2. **Failure to Include Nicotine Warning Statement:** The website's labeling and/or advertising for numerous e-liquid products (e.g., BMF Saltz, JM Saltz, Blnd’d, Buster) lacked the required "WARNING: This product contains nicotine. Nicotine is an addictive chemical" statement, violating 21 C.F.R. § 1143.3(a) and/or (b). This misbrands the products under section 903(a)(7)(B), and also under 903(a)(1) and/or 903(a)(7)(A) due to misleading advertising by omission of material facts.
