FDA WARNING_LETTER - Bahamn, Inc d/b/a E-Cig Warehouse - April 15, 2025

On April 10, 2025, the FDA Center for Tobacco Products issued a Warning Letter to Bahamn, Inc. d/b/a E-Cig Warehouse, following a review of inspection records. The letter states that Bahamn, Inc. sells and/or distributes e-liquid products, which are considered tobacco products under section 201(rr) of the FD&C Act, as they are made or derived from tobacco or contain nicotine from any source and are intended for human consumption.

The primary violation identified is the marketing of "new tobacco products" without the required premarket authorization order. Specifically, the product "Slammin Duo Iced Passion Fruit Fiji Ice .3% 100ML" was cited. This product is deemed a new tobacco product because it was not commercially marketed in the United States as of February 15, 2007, and lacks an FDA marketing authorization order or exemption. Consequently, the product is adulterated under section 902(6)(A) and misbranded under section 903(a)(6) of the FD&C Act.

The FDA requires Bahamn, Inc. to take prompt action to address these violations and bring all tobacco products into compliance with the FD&C Act and its implementing regulations.
