Under the Federal Food, Drug, and Cosmetic Act (FD&C Act), products intended to affect the body"s structure or function, or to diagnose, cure, mitigate, treat, or prevent disease, are considered drugs. Since these "new drugs" are not generally recognized as safe and effective, and lack the required FDA approval, their introduction into interstate commerce violates sections 301(d) and 505(a) of the FD&C Act.
The FDA requires Beach Weekend Management LLC to respond within fifteen working days, detailing specific corrective actions taken to address the violations. The company must explain measures to prevent recurrence, provide supporting documentation, or submit reasoning if they believe their products are not in violation. Failure to comply may result in further regulatory action, including seizure or injunction. The letter also notes that if the products are reformulated not to be drugs, they could fall under regulations for tobacco products or foods, each with their own strict premarket authorization requirements.
