FDA WARNING_LETTER - cigs-shop.net
The FDA Center for Tobacco Products issued a Warning Letter to cigs-shop.net after reviewing their website and determining that their cigarette products are offered for sale to U.S. customers. The FDA found multiple violations of the Federal Food, Drug, and Cosmetic Act (FD&C Act).
Firstly, Pall Mall Red cigarettes were found to be misbranded under section 903(a)(7)(B) of the FD&C Act because they were sold to a person younger than 18 years of age, violating 21 C.F.R. § 1140.14(a).
Secondly, several cigarette products were deemed adulterated under section 902(8) of the FD&C Act because they are modified risk tobacco products sold without an FDA order. These products were described using terms like "light," "mild," "lower amounts of Tar and Nicotine," or "low-tar" in their labeling or advertising, which classifies them as modified risk tobacco products under section 911(b)(2)(A) of the FD&C Act.
Finally, Dunhill International cigarettes were found to be adulterated under section 902(5) or misbranded under section 903(a)(1) or 903(a)(7)(A) of the FD&C Act because they purport to contain a characterizing flavor (e.g., "sweet taste of
