FDA WARNING_LETTER - Frontier Vapor - June 02, 2020
On May 22, 2020, the FDA's Center for Tobacco Products issued a Warning Letter to Frontier Vapor after reviewing their website, https://frontiervapor.com. The FDA determined that several e-liquid products advertised and sold on the website are tobacco products under section 201(rr) of the FD&C Act.
The primary violation identified is that the advertising for e-liquid products, including "Northern Lights Vapor Co. - $100 Apple Pie," "Aetherium Piña," "Frontier Vapor - Chocolate Creampuff," "Frontier Vapor – Hypnozone," and "Hop Harvest Citra/Cascade April 2014 Reissue," fails to include the required nicotine warning statement: "WARNING: This product contains nicotine. Nicotine is an addictive chemical." This omission renders the products misbranded under sections 903(a)(7)(B) and 903(a)(7)(A) of the FD&C Act, violating 21 CFR 1143.3(b). The FDA considers the lack of this material fact in advertising to be misleading.
Frontier Vapor is required to immediately correct these violations and ensure all tobacco products, labeling, and advertising comply with the FD&C Act and FDA regulations across all platforms. Failure to comply may result in further FDA action, including civil money penalties, no-tobacco-sale orders, criminal
