The agency expressed serious concerns about Delta-8 THC products, citing potential health risks, adverse event reports (over 300 from 2021-2023, nearly half involving hospitalization), psychoactive effects, and concerns about manufacturing processes and appeal to children. The products mimic well-known snack brands, increasing the risk of accidental consumption by children.

Introducing adulterated food into interstate commerce is a prohibited act under section 301(a) of the Act, 21 U.S.C. 331(a).
