On March 29, 2019, the FDA issued a Warning Letter to V Star Enterprises, specifically Benedict Tan, regarding violations observed on their website, vapevandal.com. The FDA determined that V Star Enterprises offers for sale or distribution cigarette products, specifically "Marlboro - Mint 200 Heat Sticks (Designed for use with IQOS)," to U.S. customers.
The product was found to be adulterated under section 902(6)(A) of the FD&C Act for lacking required FDA marketing authorization. It was also misbranded under section 903(a)(6) for not providing required notice or information, and under section 903(a)(7)(B) because it was sold to a person younger than 18 years of age, violating 21 C.F.R. § 1140.14(a). Additionally, the product is adulterated under section 902(5) or misbranded under section 903(a)(1) or 903(a)(7)(A) because it purports to contain a characterizing flavor (mint), which is prohibited for cigarettes under section 907(a)(1)(A) of the FD&C Act.
