The letter identifies two main violations:
1. **Modified Risk Tobacco Product Violations:** Several cigarette products, including Camel Blue, Davidoff Gold, and Marlboro Gold, are advertised using descriptors like "light" or "super light." Under section 911(b)(2)(A)(ii) of the FD&C Act, such products are classified as "modified risk tobacco products." Selling or distributing these without an FDA order under section 911(g) of the FD&C Act makes them adulterated under section 902(8) of the FD&C Act.
2. **Flavored Cigarette Violations:** Products like DJ (Apple), Esse (Aura Strawberry), and Marlboro Crisp Mint are offered for sale, purporting to contain characterizing flavors. Section 907(a)(1)(A) of the FD&C Act prohibits cigarettes from containing artificial or natural characterizing flavors (other than tobacco or menthol).
