FDA WARNING_LETTER - Indus Enterprises, Inc. d/b/a Texas Jasmine
The FDA's Center for Tobacco Products issued a Warning Letter to Mr. Momin, affiliated with Texas Jasmine, regarding misbranded cigarette and smokeless tobacco products promoted on http://www.TJonlinestore.com, http://www.TexasJasmine.com, and http://www.TexasJasmine.net. The FDA determined these websites are linked to Texas Jasmine, located at 7051 Southwest Freeway, Houston, TX 77074.
The violation stems from the promotion and sale of tobacco products using descriptors such as "light" and "ultra light" in product advertising and names, including "American Spirit Light/Mellow Kings Box," "Basic Ultra Light/Blue 100 Box," and "Marlboro Light/Gold 100 Box." Under section 903 of the FD&C Act (21 U.S.C. § 387c), such terms are deemed false and/or misleading, as Congress found consumers mistakenly believe "light" cigarettes cause fewer health problems.
The letter requires immediate correction of these violations and submission of a written response within 15 working days detailing corrective actions, including dates of discontinued violative promotion, advertising, sale, and/or distribution. Failure to comply may result in further FDA action, including civil money penalties, criminal prosecution, seizure, and/or injunction. Adulterated and misbranded tobacco products are also subject to detention and refusal
