FDA WARNING_LETTER - Mary Jane's Bakery Co. LLC - July 16, 2024
The FDA and FTC issued a Warning Letter to Miami Rave LLC, citing violations related to the marketing and sale of Delta-8 THC products. The agencies reviewed the company's websites, www.maryjanesbakeryco.com and www.miamirave.com, in February, March, April, and June 2024.
The FDA determined that several products, including "Stoney Sour Gummy Bears," "Stoney Ranchers Hard Candy," "Dank Ropes," "Stoney Patch Sour Watermelon Slices," "Slizzles," "Flaming Hot Weedos," and "Trips Ahoy Chocolate Chip Cookies," are adulterated under section 402(a)(2)(C)(i) of the Federal Food, Drug, and Cosmetic Act (the Act), 21 U.S.C. 342(a)(2)(C)(i). This is because they contain Delta-8 THC, which is considered an unsafe food additive. The FDA states that Delta-8 THC is not approved as a food additive and is not generally recognized as safe (GRAS) for use in conventional foods. Introducing adulterated food into interstate commerce is a prohibited act under section 301(a) of the Act, 21 U.S.C. 331(a).
