FDA WARNING_LETTER - shopwithsweet.com - July 01, 2025

On June 20, 2025, the FDA's Center for Tobacco Products issued a Warning Letter to shopwithsweet.com (13041 Rosecrans Ave, Ste 205, Norwalk, CA 90650) for offering illegal tobacco products for sale or distribution in the U.S. The FDA reviewed the website https://shopwithsweet.com and found Electronic Nicotine Delivery System (ENDS) products, specifically "Elfbar BC5000 Thermal Edition 5000 Puff Disposable – Sour Grape Chew" and "Elfbar TE5000 Disposable Vape 5000 Puffs – Strawberry Ice Cream," which are considered "new tobacco products."

These products are deemed "new tobacco products" because they were not commercially marketed in the U.S. as of February 15, 2007, and lack the required premarket authorization order under section 910(c)(1)(A)(i) of the FD&C Act (21 U.S.C. § 387j(c)(1)(A)(i)). Consequently, these products are adulterated under section 902(6)(A) of the FD&C Act (21 U.S.C. § 387b(6)(A)) and misbranded under section 903(a)(6) of the FD&
