FDA WARNING_LETTER - The Vapor Hut, LLC - November 05, 2019

The FDA issued a Warning Letter to William Watson of Vapor Hut on October 25, 2019, following a review of their website, https://www.vaporhut.net. The FDA determined that Vapor Hut manufactures and sells e-liquid products, which are classified as tobacco products under section 201(rr) of the FD&C Act.

The primary violation identified was the sale of a misbranded tobacco product, specifically "Magic Monkey Apple Pie e-liquid," to a person younger than 18 years of age. This violates section 903(a)(7)(B) of the FD&C Act (21 U.S.C. § 387c(a)(7)(B)) and 21 C.F.R. § 1140.14(b), which prohibits the sale of covered tobacco products to minors.

Vapor Hut is required to immediately correct this violation and any similar issues across all sales platforms. Failure to comply may result in further FDA actions, including civil money penalties, no-tobacco-sale orders, criminal prosecution, seizure, and/or injunction. A written response detailing corrective actions, including dates of discontinued sales and a plan for ongoing compliance, must be submitted within 15 working days to the FDA Center for Tobacco Products.
