FDA WARNING_LETTER - VapeSourcing - March 04, 2019
On March 4, 2019, the FDA's Center for Tobacco Products issued a Warning Letter to VapeSourcing after reviewing their website, https://vapesourcing.com. The FDA determined that several e-liquid products advertised and sold to U.S. customers are misbranded tobacco products.
The core violation is the failure to include the required nicotine warning statement on the labeling and/or advertising for numerous e-liquid products, such as Mr Salt E Grapplemelon Ice E-juice and VGOD Cubano Black E-Juice. Under 21 C.F.R. § 1143.3, all covered tobacco products, including e-liquids, must bear the warning: "WARNING: This product contains nicotine. Nicotine is an addictive chemical." This omission violates 21 C.F.R. § 1143.3(a) and/or (b).
Consequently, the e-liquid products are misbranded under section 903(a)(7)(B) of the FD&C Act (21 U.S.C. § 387c(a)(7)(B)) for violating regulations under section 906(d). Additionally, the products are misbranded under section 903(a)(1) and/or 903(a)(7)(A) of the FD&C Act (21
