The FDA reviewed Wonder Natural Foods Corp.'s Better'n Peanut Butter Original (16 oz.) product label in February 2015 and its website (www.betternpeanutbutter.com) in June 2015. The product is misbranded under section 403 of the Federal Food, Drug, and Cosmetic Act (the Act) [21 U.S.C. § 343] and 21 CFR 101 due to several violations.
Firstly, the product is misbranded under section 403(r)(1)(A) of the Act because it bears unauthorized nutrient content claims. The website claims "healthy" in connection with "low fat, low calorie," but the product does not meet the "healthy" criteria (21 CFR 101.65(d)(2)) as it lacks 10% RDI/DRV for specified nutrients. The "low calorie" claim is invalid as the product exceeds 40 calories per RACC and 50g (21 CFR 101.60(b)(2)(i)(B)).
