Additionally, products like Kent cigarettes ("safer than other brands") and Virginia Slims ("light on the nicotine content") were marketed as having lower risk or reduced substance levels, also classifying them as modified risk tobacco products requiring an FDA order.
Secondly, numerous flavored cigarette products (e.g., Aroma Rich Apple, Kiss Super Slims Fresh Apple 100’s, Richmond Cherry, Sobranie Slims Mints 100’s) were found to be "adulterated" under section 902(5) of the FD&C Act because they purport to contain a characterizing flavor other than tobacco or menthol, which is prohibited for cigarettes as of September 22, 2009, under section 907(a)(1)(A).
