The FDA Center for Tobacco Products reviewed http://www.cheapestdiscountcigarettes.com and found cigarette products offered for sale in the U.S. These products are subject to FDA jurisdiction under the FD&C Act. The FDA determined several cigarette products are adulterated under section 902(8) of the FD&C Act because they are modified risk tobacco products sold without an FDA order.
Specifically, products like "Esse Lights," "Winston Xstyle Lights," and "Marlboro Gold Ultra Lights" use descriptors "Lights" or "Ultra Lights" in their labeling or advertising. Under section 911(b)(2)(A)(ii) of the FD&C Act, such descriptors classify them as "modified risk tobacco products." Section 911(a) prohibits introducing modified risk tobacco products into interstate commerce without an FDA order under section 911(g). Violations of section 911(a) result in adulteration under section 902(8).
The letter requires immediate correction of these violations and similar ones, ensuring all tobacco products and promotional materials comply with the FD&C Act. Failure to comply may lead to civil money penalties, no-tobacco-sale orders, criminal prosecution, seizure, and/or injunction. Adulterated and misbranded imported products are subject to detention.
