FDA WARNING_LETTER - www.cigs4u.net - September 30, 2011
On August 17, 2011, the FDA issued a Warning Letter to www.cigs4u.net and www.eugcr.net after reviewing their websites and determining that their cigarette products were offered for sale to U.S. customers. The FDA believes the websites are affiliated due to a shared contact number.
The FDA determined that several products are adulterated under section 902(8) of the FD&C Act (21 U.S.C. § 387b(8)) because they are promoted as modified risk tobacco products without an FDA order. Specifically, products like "Marlboro Gold (Lights)" and "West Blue Ultra Light" use descriptors such as "light," "super light," or "ultra light," which classify them as modified risk tobacco products under section 911(b)(2)(A)(ii) of the FD&C Act (21 U.S.C. § 387k(b)(2)(A)(ii)). Introducing such products into interstate commerce without an FDA order under section 911(g) (21 U.S.C. § 387k(g)) renders them adulterated.
Additionally, Kiss Superslims Energy (Peach Flavor), Kiss Superslims Fresh Apple, and Kiss Superslims Strawberry cigarettes are adulterated under section 902(5) of the FD&C
