The FDA Center for Tobacco Products reviewed the website http://www.hqcigarettes.com and determined that its cigarette products are offered for sale or distributed in the U.S., making them subject to FDA jurisdiction. The FDA found several violations of the Federal Food, Drug, and Cosmetic Act (FD&C Act).

Firstly, numerous cigarette products, including those listed under "LIGHTS CIGARETTES" and "ULTRA LIGHTS CIGARETTES," and products described as having reduced levels of substances (e.g., "Kent Light with a minimum amount of tar and nicotine"), are deemed "modified risk tobacco products" under section 911(b)(2)(A) of the FD&C Act.
